Influencer Emilie Kiser\u2019s husband Brady will not face criminal charges in the drowning death of their three-year-old son, Trigg.<\/p>\n

Trigg Kiser fell into the pool at their home in\u00a0Phoenix<\/a><\/u><\/strong>, Arizona, on May 12 and died in hospital a week later.<\/a><\/p>\n

His mother, Emilie, 26, regularly posted on social media<\/a><\/u><\/strong> until the accident, and her sudden silence had many fans speculating about what might have happened.<\/p>\n

Their questions were answered on May 18 when police in Phoenix, Arizona, confirmed that Trigg had died, causing an outpouring of grief from Emilie\u2019s 4.1million TikTok<\/a> followers.<\/p>\n

A decision to not pursue charges was announced on Friday by\u00a0Arizona’s Maricopa County Attorney’s Office \u2014 two weeks after Chandler Police\u00a0recommended a felony child abuse charge in connection with the incident.<\/p>\n

‘Every case submitted to the Maricopa County Attorney’s Office is evaluated using the same standard: whether there is a ‘reasonable likelihood of conviction,’ Maricopa County Attorney Rachel Mitchell said in a statement.<\/p>\n

‘After careful review of the evidence submitted by Chandler PD, it was determined this case does not meet that standard.’<\/p>\n

Prosecutors emphasised that, to pursue a child abuse charge, they would need to prove that Brady, 28, ‘failed to perceive a substantial and unjustifiable risk’ and that his actions were a ‘gross deviation from the standard of care a reasonable person would show.’<\/p>\n

His attorney, Flynn Carey, said in a statement that his client is grateful the case was thoroughly reviewed and classified as a tragic accident.<\/p>\n

‘We are grateful to law enforcement and the county attorney for conducting a thorough investigation and confirming that this was a tragic accident. <\/p>\n

‘Brady remains in the midst of the grieving process and is thankful to be with his family as they heal together,’ Carey said.<\/p>\n

‘We appreciate the compassion and support shown during this difficult time.’<\/p>\n

Authorities say Brady was\u00a0home alone with Trigg and the couple’s newborn son,\u00a0Theodore, when the toddler accessed the backyard pool and was found then unresponsive.<\/p>\n

At the time of the incident Emilie was not home. According to police, she had been out with friends.<\/p>\n

While the couple has not spoken publicly since their son\u2019s death, Emilie\u2019s lawyer later issued a statement that read: \u2018Emilie is going through a parent\u2019s worst nightmare right now.\u2019<\/p>\n

She went on to confirm how Trigg had died, adding that it was accidental, before saying: \u2018Emilie is trying her best to be there for her surviving son, two-month-old Theodore. But every day is a battle.\u2019<\/p>\n

Emilie, who built up an online following with updates on children and family life, released the statement as part of a bid to block the release of records surrounding Trigg\u2019s death.<\/p>\n

The family said it had become a media frenzy with more than 100 public record requests.<\/p>\n

Emilie and Brady welcomed Trigg in July 2021 and their second son, Theodore, in September 2024.<\/p>\n
